Legal Advice on Requesting a Motion to Reconsider a Deportation Case before the Immigration Court
When an Immigration Judge imposes a deportation order on a person, and the person concerned believes that the judge made a mistake in making that decision, a motion to reconsider must be filed at the Immigration Court within 30 days of the decision.
The motion to reconsider must tell the Immigration Judge what mistakes he made in his decision and how those mistakes caused him to issue an erroneous deportation order. The purpose of the motion to reconsider is for the Immigration Judge to acknowledge his mistake, reverse his deportation order, and allow the person affected by the decision to continue to fight his or her case.
